Dr. Matthew Achigbe who was, at the second APC state congress of Sunday, May 27 pronounced state chairman alongside Barrister Egere Effiom Osim, a notable member of APC Cross River has taken the inaugurated state executive council of the party under the chairmanship of Mr. John Etim, the party as a whole, and the Independent Electoral Commission, INEC to court.
In a suit marked HCA/15/2018 of the Cross River State High Court, Akpabuyo division, Dr. Achigbe and Barr. Egere are seeking an injunctive order restraining Mr. Etim and the rest members of his council from carrying out any duty as State EXCO of the party pending the hearing and determination of Motion on Notice filed for the annulment of the May 19th state congress of the party.
On the side of APC Cross River State and INEC, the suit prayed the court to restrain them from acknowledging or dealing with Mr. Etim’s team as State EXCO of the party.
The court, after hearing from Barr. Joseph Oloko of counsel to Dr. Achigbe and Barr. Egere granted the prayers of the claimants and thus moved a motion of temporal order restraining Mr. John Etim and his team from functioning as EXCO members and also, APC Cross River State and INEC from recognising them as such pending when the case would be heard and determined.
Accordingly, the court has fixed 7th June, 2018 for hearing.
